Sanksi Terhadap Shooting Film yang Tidak Memiliki Izin

Dasar Hukum: Undang-Undang Nomor 33 Tahun 2009 tentang Perfilman

Dalam menyelenggarakan suatu kegiatan usaha khususnya di bidang komersial, maka izin usaha adalah hal yang diperlukan oleh pelaku usaha agar bisa melanjutkan kegiatan usahanya, melalui prosedur-prosedur yang sudah ditetapkan oleh Pemerintah. Prosedur-prosedur yang harus dipenuhi oleh pelaku usaha tersebut juga merupakan langkah yang harus dipenuhi untuk mendapatkan izin secara legal yang dicatatkan oleh Pemerintah, sekaligus memiliki manfaat sebagai sarana perlindungan hukum. Seperti contoh, apabila pelaku usaha perfilman ingin melakukan usaha pembuatan film, melalui proses shooting film dan penyiaran, maka harus melakukan proses perizinan dan mendapatkan izin dari pihak yang mempunyai kewenangan dalam hal tersebut.

Memperoleh izin tersebut harus mengikuti prosedur-prosedur yang berlaku, dan izin tersebut harus sudah didapatkan sebelum shooting dilaksanakan. Izin biasanya diperlukan apabila pelaku usaha film menggunakan tempat umum, dan bukti pemberian izin oleh pihak yang berwenang biasanya berbentuk surat yang berisi perihal dan tanda tangan oleh pihak yang berwenang (dalam bentuk tulisan).

Selain itu, permintaan izin juga merupakan bagian dari etika yang berkaitan dengan moral, dimana etika merupakan unsur yang diterapkan dalam kode etik profesi pelaku usaha perfilman memiliki kode etik yang harus dipatuhi.

Mengacu pada Pasal 17 ayat (1) Undang-Undang Nomor 33 Tahun 2009 tentang Perfilman menjelaskan bahwa pembuatan film oleh pelaku usaha pembuatan film dalam hal ini harus didahului menyampaikan pemberitahuan film kepada Menteri, dengan disertai dengan judul film, isi cerita, dan rencana pembuatan film. Serta dijelaskan pada Pasal 18 ayat (1) & ayat (3) Peraturan Menteri Pendidikan dan Kebudayaan Nomor 25 Tahun 2018 tentang Perizinan Berusaha Terintegrasi Secara Elektronik Sektor Pendidikan dan Kebudayaan, dijelaskan bahwa Pelaku Usaha pembuatan film yang akan membuat film wajib memiliki Tanda Pemberitahuan Pembuatan Film (TPPF) dimana TPPF tersebut harus meliputi : 

  1. nama pemilik hak cipta atas film yang dibuat; 
  2. judul film; 
  3. isi cerita/sinopsis dalam bahasa Indonesia; 
  4. nama produser, sutradara, dan penulis; dan 
  5. jadwal dan lokasi pembuatan film. [2]

Apabila tidak terpenuhinya izin lokasi atau izin tidak diberikan oleh pihak yang berwenang pada tempat/lokasi tersebut, maka dapat dikatakan tidak terpenuhinya syarat untuk memperoleh izin pembuatan film melalui Tanda Pemberitahuan Pembuatan Film (TPPF).

Selain itu, mengacu pada Pasal 6 ayat (1) dan ayat (2) Peraturan Menteri Pendidikan dan Kebudayaan Nomor 11 Tahun 2021 tentang Tata Cara Pengenaan Sanksi Administratif Terhadap Pelanggaran Perizinan Berusaha Sektor Kebudayaan, dinyatakan bahwa: 

“ Pasal 6

  • Setiap Pelaku Usaha, yang berdasarkan hasil Pengawasan ditemukan ketidaksesuaian atau pelanggaran terhadap Perizinan Berusaha di sektor kebudayaan, dikenai sanksi administratif. 
  • Sanksi administratif sebagaimana dimaksud pada ayat (1) berupa:
    • teguran tertulis; 
    • denda administratif; 
    • penutupan sementara; 
    • pengenaan daya paksa polisional; dan/atau 
    • pembubaran atau pencabutan Perizinan Berusaha. [3]

Pada Pasal 5 jo. Penjelasan Pasal 5 Undang-Undang Nomor 33 Tahun 2009 tentang Perfilman, dijelaskan bahwa kegiatan perfilman dan usaha perfilman dilakukan berdasarkan kebebasan berkreasi, berinovasi, dan berkarya dengan menjunjung tinggi nilai-nilai agama, etika, moral, kesusilaan, dan budaya bangsa. Yang dimaksud menjunjung tinggi adalah harus sejalan dan tidak boleh bertentangan.

Terkait dengan proses shooting izin dan terdapat pelanggaran etika dan moral yang dilakukan oleh rumah produksi, maka film tersebut tidak boleh ditayangkan atau disiarkan terkait dengan pelanggaran kode etik penyiaran yang harus dipatuhi oleh stasiun televisi, tercantum dalam Pasal 10 ayat (1) Peraturan Komisi Penyiaran Indonesia Nomor 01/P/KPI/03/2012 tentang Pedoman Perilaku Penyiaran : 

“(1) Lembaga Penyiaran wajib memperhatikan etika profesi yang dimiliki oleh profesi tertentu yang ditampilkan dalam isi siaran agar tidak merugikan dan menimbulkan dampak negatif di masyarakat.”[4]

 Berkaitan dengan kewenangan KPI pada Pasal 8 ayat (2) huruf d Undang-Undang Nomor 32 Tahun 2002 tentang Penyiaran yang menjelaskan bahwa KPI dalam menjalankan fungsinya mempunyai wewenang untuk memberikan sanksi terhadap pelanggaran peraturan dan pedoman perilaku penyiaran serta standar program penyiaran. [5]

Pemenuhan syarat dalam perizinan suatu kegiatan usaha yang dilakukan oleh pelaku usaha dalam hal ini pelaku usaha perfilman, perlu dilakukan untuk dalam hal melaksanakan kewajiban hukum yang harus dipenuhi, pelaku usaha yang tidak memiliki izin dapat dikenai sanksi yang bersifat administratif hingga pembubaran/pencabutan perizinan berusaha.

Legal Basis: Law Number 33 of 2009 concerning Film

In carrying out a business activity, especially in the commercial sector, a business license is something that is needed by business actors in order to be able to continue their business activities, through procedures that have been determined by the Government. The procedures that must be met by business actors are also steps that must be fulfilled to obtain a license legally registered by the Government, as well as having benefits as a means of legal protection. For example, if a film business actor wants to do a film-making business, through the film shooting and broadcasting process, then they must carry out a licensing process and get permission from the party who has the authority in this regard.

Obtaining the permit must follow the applicable procedures, and the permit must be obtained before shooting is carried out. Permits are usually required if the film business actor uses a public place, and evidence of granting a permit by the competent authority is usually in the form of a letter containing the subject matter and signature by the authorized party (in writing).

Aside from that, the request for permission is also part of ethics related to morals, where ethics is an element that is applied in the professional code of ethics for film business actors who have a code of ethics that must be obeyed.

Referring to Article 17 paragraph (1) of Law Number 33 of 2009 concerning Film, it is explained that filmmaking by film-making business actors in this case must be preceded by submitting a film notification to the Minister, accompanied by the title of the film, the content of the story, and the plan for making the film. As well as explained in Article 18 paragraph (1) & paragraph (3) of the Regulation of the Minister of Education and Culture Number 25 of 2018 concerning Electronically Integrated Business Licensing in the Education and Culture Sector, it is explained that filmmaking Business Actors who will make films are required to have a Film Making Notification Sign (TPPF) where the TPPF must include:

  1. the name of the copyright owner for the film made;
  2. movie title;
  3. the content of the story/synopsis in Indonesian;
  4. names of producers, directors and writers; and
  5. filming schedule and location

If the location permit is not fulfilled or the permit is not granted by the competent authority at the place/location, it can be said that the requirements for obtaining a filmmaking permit are not met through the Film Making Notification Sign (TPPF).

Aside from that, referring to Article 6 paragraph (1) and paragraph (2) of the Regulation of the Minister of Education and Culture Number 11 of 2021 concerning Procedures for Imposing Administrative Sanctions for Violations of Business Licensing in the Cultural Sector, it is stated that:

” Article 6

  • Every Business Actor, based on the results of Supervision found a discrepancy or violation of the Business Licensing in the cultural sector, is subject to administrative sanctions.
  • The administrative sanctions as referred to in paragraph (1) are in the form of:
    • written warning; 
    • administrative fines; 
    • temporary closure; 
    • the imposition of police coercion; and/or
    • dissolution or revocation of Business License.“

In Article 5 jo. Elucidation of Article 5 of Law Number 33 of 2009 concerning Film, it is explained that film activities and film business are carried out based on freedom to be creative, innovate, and work by upholding religious values, ethics, morals, decency, and national culture. What is meant by upholding is that it must be in line and must not be contradictory.

Related to the shooting permit process and there are ethical and moral violations committed by the production house, the film may not be shown or broadcast related to violations of the broadcasting code of ethics that must be obeyed by television stations, as stated in Article 10 paragraph (1) of the Indonesian Broadcasting Commission Regulation. Number 01/P/KPI/03/2012 concerning Guidelines for Broadcasting Conduct:

“(1) Broadcasting institutions are required to pay attention to the professional ethics of certain professions that are displayed in broadcast content so as not to harm and cause negative impacts in society.”

In relation to the authority of KPI in Article 8 paragraph (2) letter d of Law Number 32 of 2002 concerning Broadcasting which explains that KPI in carrying out its functions has the authority to provide sanctions for violations of regulations and guidelines for broadcasting behavior as well as broadcasting program standards.

Fulfillment of requirements in licensing a business activity carried out by business actors, in this case film business actors, needs to be carried out in order to carry out legal obligations that must be fulfilled, business actors who do not have permits may be subject to administrative sanctions up to the dissolution/revocation of business licenses.
