Perkembangan
pembangunan di Indonesia tidak terlepas dari peranan para arsitektur yang
menghasilkan karya-karya hak cipta dibidang arsitektur, hal ini dapat terlihat
dengan jelas terutama pembangunan aspek fisiknya, dimana banyak sekali terdapat
bangunan- bangunan indah dan megah dengan gaya arsitektur yang bervariasi
antara satu dengan yang lain. Konstruksi bangunan tersebut dapat berupa rumah
tinggal, perkantoran, pusat perbelanjaan, pusat rekreasi, dan lainnya, yang
mempunyai nilai artistik yang khas dan unik dengan gaya- gaya arsitektur yang
indah.[1] Namun, di Indonesia sendiri perlindungan dan pembahasan mengenai
perlindungan karya arsitektur juga jarang dibahas terlebih juga karena masih
kurangnya kesadaran mengenai perlindungan karya arsitektur. Berdasarkan hal ini,
maka timbul pertanyaan, bagaimana seharusnya perlindungan Hak Cipta terhadap
karya arsitektur yang didesain menggunakan program komputer?
Pada
umumnya arsitektur didefinisikan sebagai Seni penciptaan ruang dan bangunan
untuk memberi wadah kepada kehidupan bersama.[2] Selanjutnya
menurut Van Romondt, salah seorang guru besar Institut Teknologi Bandung (ITB),
arsitektur adalah ruang tempat hidup manusia dengan berbahagia.[3] Arsitektur
dalam pengertian di atas hanya diasosiasikan dengan penciptaan
bangunan-bangunan dan ruangan-ruangan yang indah dan hanya sebagai tempat bagi
kehidupan manusia. Arsitektur yaitu suatu seni untuk mendesain bangunan
sehingga mempunyai nilai keindahan/estetika. Keindahan adalah nilai-nilai yang
menyenangkan mata, pikiran dan telinga.[4]
Sementara program komputer memiliki pengertian berdasarkan Pasal 1 angka (9) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta yaitu:
“Pasal 1
9.Program Komputer adalah seperangkat instruksi yang diekspresikan dalam bentuk bahasa, kode, skema, atau dalam bentuk apapun yang ditujukan agar komputer bekerja melakukan fungsi tertentu atau untuk mencapai hasil tertentu”.
Pengertian Hak Cipta sendiri tercantum dalam Pasal 1 angka 1 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta yang menyatakan bahwa:
“Pasal
1
1. Hak Cipta adalah hak eksklusif pencipta yang timbul secara otomatis berdasarkan prinsip deklaratif setelah suatu ciptaan diwujudkan dalam bentuk nyata tanpa mengurangi pembatasan sesuai dengan ketentuan peraturan perundang-undangan”.
Hak
cipta lahir dan timbul dari hasil olah pikir manusia dalam bidang ilmu
pengetahuan, kesenian, dan sastra. Hak cipta timbul secara otomatis seketika
suatu ciptaan lahir. Hak cipta merupakan hak perdata yang melekat pada diri pihak
pencipta. Hak cipta merupakan hak privat. Pembenarannya ialah karena suatu
ciptaan dilahirkan oleh kreasi pencipta. Kreasi yang muncul dari adanya olah
pikiran dan kreativitas dari sang pencipta. Suatu hak cipta haruslah lahir dari
kreativitas manusia bukan yang telah ada di luar aktivitas atau di luar hasil
kreativitas manusia. Hak cipta merupakan hak eksklusif yang terdiri atas hak
moral dan hak ekonomi. Disebut hak eksklusif karena hak tersebut hanya
diperuntukkan bagi pencipta, dengan demikian melarang/membatasi pihak lain
untuk menggunakan hak tersebut tanpa izin pencipta. Pemegang hak cipta yang
bukan pencipta hanya memiliki Sebagian dari hak ekslusif yaitu berupa hak
ekonomi. Hak moral dibedakan dengan hak ekonomi, hak ekonomi mengandung nilai ekonomis,
sedangkan hak moral sama sekali tidak memiliki nilai ekonomis.[1]
Hak moral ialah hak yang melekat kepada diri pencipta. Hak moral tidak dapat dihapus biarpun jangka waktu perlindungan hak cipta telah berakhir. Hak moral tidak dapat dialihkan selama pencipta masih, tetapi dapat dialihkan denga wasiat atau sebab lain sesuai dengan ketentuan peraturan perundang-undangan setelah pencipta meninggal dunia. Hak moral juga mencakup dalam hak-hak terkait (neighboring rights).[2]
Hak
ekonomi merupakan hak bagi pencipta atau pemegang hak cipta untuk mendapat
nilai ekonomis atas ciptaannya. Kegiatan yang dapat dilakukan oleh pemegang hak
ekonomi ialah: penerbitan ciptaan; penggandaan ciptaan dalam segala bentuk;
penerjemahan ciptaan; pengadaptasian; pengaransemen atau pentrasformasian
ciptaan; pendistribusian ciptaan atau salinannya; pertunjukkan ciptaan;
pengumuman ciptaan; komunikasi ciptaan; dan penyewaan ciptaan.[3]
Hak–hak tersebut tidak hanya memberi keuntungan terhadap diri pribadi namun juga memberikan harapan kepada pertumbuhan ekonomi kreatif, perkembangan ekonomi kreatif yang pesat perlu dibentengi dengan perlindungan hukum mengigat hak cipta menjadi basis terpenting dari ekonomi kreatif nasional.[4]
Karya arsitektur termasuk sebagai salah satu ciptaan yang dilindungi berdasarkan Pasal 40 ayat (1) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Pasal tersebut berbunyi:
“Pasal 40
(1) Ciptaan yang dilindungi meliputi Ciptaan dalam bidang ilmu pengetahuan, seni, dan sastra, terdiri atas:
a.buku, pamflet, perwajahan karya tulis yang diterbitkan, dan semua hasil karya tulis lainnya;
b.ceramah, kuliah, pidato, dan Ciptaan sejenis lainnya;
c.alat peraga yang dibuat untuk kepentingan pendidikan dan ilmu pengetahuan;
d.lagu dan/atau musik dengan atau tanpa teks;
e.drama, drama musikal, tari, koreografi, pewayangan, dan pantomim;
f.karya seni rupa dalam segala bentuk seperti lukisan, gambar, ukiran, kaligrafi, seni pahat, patung, atau kolase;
g.karya seni terapan;
h.karya arsitektur;
i.peta;
j.karya seni batik atau seni motif lain;
k.karya fotografi;
l.Potret;
m.karya sinematografi;
n.terjemahan, tafsir, saduran, bunga rampai, basis data, adaptasi, aransemen, modifikasi dan karya lain dari hasil transformasi;
o.terjemahan, adaptasi, aransemen, transformasi, atau modifikasi ekspresi budaya tradisional;
p.kompilasi Ciptaan atau data, baik dalam format yang dapat dibaca dengan Program Komputer maupun media lainnya;
q.kompilasi ekspresi budaya tradisional selama kompilasi tersebut merupakan karya yang asli;
r.permainan video; dan
s.Program Komputer.”
Selain hasil karya yang dilindungi, terdapat juga hasil karya yang tidak dilindungi hak cipta berdasarkan pasal 41 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta yaitu:
“Pasal 41
Hasil karya yang tidak dilindungi Hak Cipta meliputi:
a.hasil karya yang belum diwujudkan dalam bentuk nyata;
b.setiap ide, prosedur, sistem, metode, konsep, prinsip, temuan atau data walaupun telah diungkapkan, dinyatakan, digambarkan, dijelaskan, atau digabungkan dalam sebuah Ciptaan; dan
c.alat, benda, atau produk yang diciptakan hanya untuk menyelesaikan masalah teknis atau yang bentuknya hanya ditujukan untuk kebutuhan fungsional.
“Pasal 58
1.Pelindungan Hak Cipta atas Ciptaan:
a.buku, pamflet, dan semua hasil karya tulis lainnya;
b.ceramah, kuliah, pidato, dan Ciptaan sejenis lainnya;
c.alat peraga yang dibuat untuk kepentingan pendidikan dan ilmu pengetahuan;
d.lagu atau musik dengan atau tanpa teks;
e.drama, drama musikal, tari, koreografi, pewayangan, dan pantomim;
f.karya seni rupa dalam segala bentuk seperti lukisan, gambar, ukiran, kaligrafi, seni pahat, patung, atau kolase;
g.karya arsitektur;
h.peta; dan
i.karya seni batik atau seni motif lain,
berlaku selama hidup Pencipta dan terus berlangsung selama 70 (tujuh puluh) tahun setelah Pencipta meninggal dunia, terhitung mulai tanggal 1 Januari tahun berikutnya.
Pasal 59
1.Pelindungan Hak Cipta atas Ciptaan:
a.karya fotografi;
b.Potret;
c.karya sinematografi;
d.permainan video;
e.Program Komputer;
f.perwajahan karya tulis;
g.terjemahan, tafsir, saduran, bunga rampai, basis data, adaptasi, aransemen, modifikasi dan karya lain dari hasil transformasi;
h.terjemahan, adaptasi, aransemen, transformasi atau modifikasi ekspresi budaya tradisional;
i.kompilasi Ciptaan atau data, baik dalam format yang dapat dibaca dengan Program Komputer atau media lainnya; dan
j.kompilasi ekspresi budaya tradisional selama kompilasi tersebut merupakan karya yang asli,
berlaku selama 50 (1ima puluh) tahun sejak pertama kali dilakukan Pengumuman.
Dalam penjelasan pada Pasal 40 huruf h Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, dinyatakan bahwa yang dimaksud dengan karya arsitektur antara lain, wujud fisik bangunan, penataan letak bangunan, gambar rancangan bangunan, gambar teknis bangunan, dan model atau maket bangunan. Dari penjelasan mengenai pengertian karya arsitektur ini dapat dilihat bahwa suatu karya arsitektur tidaklah harus berbentuk bangunan nyata, melainkan cukup dengan adanya gambar rancangan saja sudah dapat dinyatakan sebagai suatu karya arsitektur.[1]
Berdasarkan penjelasan tersebut, Gambar rancangan arsitektur yang didesain melalui program komputer pun dapat mengalami pengubahan yang tidak akan dianggap sebagai pelanggaran Hak Cipta, jika pengubahan tersebut dilakukan berdasarkan pertimbangan pelaksanaan teknis[na1] , sesuai dengan ketentuan pada Pasal 44 ayat 1 dan ayat (3) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Adapun bunyi pasal tersebut ialah:
“Pasal 44
(1) Penggunaan, pengambilan, Penggandaan, dan/atau pengubahan suatu Ciptaan dan/atau produk Hak Terkait secara seluruh atau sebagian yang substansial tidak dianggap sebagai pelanggaran Hak Cipta jika sumbernya disebutkan atau dicantumkan secara lengkap untuk keperluan:
a. pendidikan, penelitian, penulisan karya ilmiah, penyusunan laporan, penulisan kritik atau tinjauan suatu masalah dengan tidak merugikan kepentingan yang wajar dari Pencipta atau Pemegang Hak Cipta;
b. keamanan serta penyelenggaraan pemerintahan, legislatif, dan peradilan;
c.ceramah yang hanya untuk tujuan pendidikan dan ilmu pengetahuan; atau
d.pertunjukan atau pementasan yang tidak dipungut bayaran dengan ketentuan tidak merugikan kepentingan yang wajar dari Pencipta
(3)Dalam hal Ciptaan berupa karya arsitektur, pengubahan sebagaimana dimaksud pada ayat (1) tidak dianggap sebagai pelanggaran Hak Cipta jika dilakukan berdasarkan pertimbangan pelaksanaan teknis.”
Selanjutnya
mengenai siapa yang berhak atas hak cipta dari suatu karya arsitektur yang
didesain pada suatu program komputer dapat diketahui berdasarkan perjanjian
yang dilakukan oleh para pihak. Dalam membuat karya arsitektur dengan
menggunakan program komputer, sebelum digunakan, pencipta karya harus
menyetujui syarat dan ketentuan penggunaan yang tercantum pada kebijakan
program komputer. Dalam hal syarat dan ketentuan penggunaan menetapkan bahwa
hak cipta atas ciptaan direncanakan untuk diproduksi dimana pencipta yang
menggunakan program komputer menyetujui syarat dan ketentuan penggunaan, maka
hak cipta atas ciptaan tersebut akan menjadi diproduksi dengan tunduk pada
perjanjian kepemilikan hak cipta yang ditetapkan berdasarkan syarat dan
ketentuan yang telah disetujui sebelumnya oleh pengguna yang tercantum pada
kebijakan program komputer.
Kemungkinan terjadinya pelanggaran hak cipta pada karya arsitektur tergolong cukup tinggi. Pelanggaran Hak Cipta pada karya arsitektur dapat berupa dilakukannya peniruan atau penjiplakan secara penuh dan utuh suatu karya cipta arsitektur tanpa seizin pencipta yang bersangkutan, juga dapat berupa meniru, menambah, merubah, beberapa bentuk dari karya cipta arsitektur tanpa seizin pencipta sehingga menghasilkan karya cipta arsitektur baru. Pelanggaran Hak Cipta peniruan terkait karya arsitektur ini berupa kemiripan hingga nyaris serupa antara karya arsitektur yang satu dengan yang lainnya. Hak Cipta merupakan permasalahan budaya dan paradigma dalam pandangan tradisional yang hingga saat ini belum sepenuhnya lenyap, bahwasanya anggapan masyarakat suatu ciptaan selaku milik bersama dan walaupun hak individu atas ciptaan mendapatkan pengakuan, tetapi bentuk yang lebih ditonjolkan lebih pada perspektif moral Hak Cipta ketimbang nilai ekonomisnya.[1] Apabila karya arsitektur dari seorang arsitek dijiplak atau ditiru tanpa izin, ia akan mengalami kerugian dari segi ekonomi maupun segi moral. Pencipta dapat manfaat ekonomi atas ciptaannya sendiri serta produk terkait karena Hak Ekonomi tersebut.[2]
Pasal
9 ayat (3) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta di dalamnya
mengatur perlindungan yang diberikan untuk para pencipta atas karyanya dimana
disebutkan:
“Pasal 9
(3) Setiap Orang yang tanpa izin Pencipta atau Pemegang Hak Cipta dilarang melakukan Penggandaan dan/atau Penggunaan Secara Komersial Ciptaan.”
Kemudian Pasal 9 ayat (1) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta mengatur hak ekonomi dari pencipta dan pemegang hak cipta sebagaimana berbunyi:
“Pasal 9
(1) Pencipta atau Pemegang Hak Cipta sebagaimana dimaksud dalam Pasal 8 memiliki hak ekonomi untuk melakukan:
a.penerbitan Ciptaan;
b.Penggandaan Ciptaan dalam segala bentuknya;
c.penerjemahan Ciptaan;
d.pengadaptasian, pengaransemenan, atau pentransformasian Ciptaan;
e.Pendistribusian Ciptaan atau salinannya;
f.pertunjukan Ciptaan;
g.Pengumuman Ciptaan;
h.Komunikasi Ciptaan;
i.penyewaan Ciptaan.
Hal
ini mendukung pihak pencipta agar apabila terjadi kasus peniruan karya cipta
arsitektur, sudah merupakan pelanggaran Hak Cipta. Dengan adanya hak ekonomi,
melarang orang lain menggunakan suatu karya cipta dengan tujuan
mengkomersialkannya tanpa seizin pencipta. Maksud dari menggunakan karya
tersebut untuk komersial sebagai halnya diatur dalam Pasal 1 angka 24
Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta yaitu pemanfaatan ciptaan
dan/atau produk terkait dengan tujuan untuk memperoleh keuntungan ekonomi dari
berbagai sumber atau berbayar.[1]
Undang-Undang
Nomor 28 Tahun 2014 tentang Hak Cipta belum mengatur secara detail mengenai
pokok-pokok dari karya arsitektur yang dapat dilindungi sebagai syarat penilaian
untuk menentukan suatu karya arsitektur bisa dikatakan sebagai karya orisinil
atau karya hasil menjiplak dari karya lain. Dari segi hak moral dan juga hak
ekonomi, perbuatan menjiplak karya arsitektur tanpa mendapatkan izin dari
pencipta atau pemegang Hak Cipta untuk mengkomersialkannya merupakan suatu
pelanggaran.[2]
Pasal 99 ayat (1) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta mengatur bahwa gugatan perdata dapat diajukan oleh pencipta atau pemegang Hak Cipta karya arsitektur yang mengalami kerugian karena terjadi pelanggaran atas karyanya. Adapun bunyi pasal tersebut ialah:
“Pasal

- Pencipta,
Pemegang Hak Cipta, atau pemilik Hak Terkait berhak mengajukan gugatan ganti
rugi kepada Pengadilan Niaga atas pelanggaran Hak Cipta atau produk Hak
Terkait.”
Tidak
hanya gugatan perdata yang dapat diajukan oleh pencipta atau pemegang, tuntutan
pidana juga dapat diajukan terhadap pelaku pelanggaran hak cipta karya
arsitektur tanpa izin pencipta yang karya baru dari hasil peniruan tersebut
dikomersialisasikan. Pasal 113 ayat (3) Undang-Undang Nomor 28 Tahun 2014
tentang Hak Cipta mengatur ketentuan pidananya yang berbunyi:
“Pasal
113
melakukan
pelanggaran hak ekonomi Pencipta yang berbentuk penerbitan Ciptaan, segala
bentuk penggandaan ciptaan, pendistribusian ciptaan atau salinannya, dan/atau
pengumuman ciptaan untuk digunakan secara komersial dipidana dengan pidana
penjara paling lama 4 (empat) tahun dan/atau pidana denda paling banyak
Rp1.000.000.000,00 (satu miliar rupiah).”
Semenjak berlakunya Undang – Undang Hak Cipta terbaru yakni
Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta menyatakan bahwa pelanggaran
Hak Cipta merupakan delik aduan, sebagai halnya tercantum dalam Pasal 120 UU
Hak Cipta tindak pidana sebagaimana dimaksud dalam undang-undang ini merupakan
delik aduan. Bisa disimpulkan bahwa harus ada orang yang melapor dahulu dengan
permintaan untuk melakukan tuntutan terhadap orang atau pihak tertentu agar
tindak pidana dapat dilakukan penuntutan.[1]
Harapan
kedepannya terjadinya suatu pelanggaran hak cipta bisa dicegah dengan adanya
pengaturan serta sanksi pidana yang besar, terutama di bidang karya arsitektur
yang memiliki kemungkinan terjadinya suatu pelanggaran hak cipta di kemudian
hari. Sangat dianjurkan kepada pencipta maupun pemegang hak cipta agar karya
ciptanya dicatatkan, walaupun tidak memerlukan pencatatan karena Hak Cipta
bersifat otomatis yang muncul ketika sebuah karya telah tercipta. Apabila di
kemudian hari terjadi sengketa atas suatu karya cipta, Surat Pencatatan Ciptaan
tersebut dapat digunakan sebagai alat bukti di Pengadilan.[2] Oleh
karena itu, penting untuk mencatatkan karya arsitektur sebagaimana diatur dalam
Pasal 21 Undang-Undang Nomor 6 Tahun 2017 tentang Arsitek yang mengatur bahwa
arsitek berhak mendaftarkan kekayaan intelektual atas hasil karyanya.

The
development of development in Indonesia cannot be separated from the role of
architects who produce copyrighted works in the field of architecture, this can
be seen clearly, especially the development of the physical aspect, where there
are so many beautiful and magnificent buildings with architectural styles that
vary from one to another. other. The construction of the building can be in the
form of residential houses, offices, shopping centers, recreation centers, and
others, which have distinctive and unique artistic values with beautiful
architectural styles. However, in Indonesia itself, the protection and
discussion of the protection of architectural works is also rarely discussed,
especially because there is still a lack of awareness about the protection of
architectural works. Based on this, the question arises, how should copyright
protection be applied to architectural works designed using computer programs?
In
general, architecture is defined as the art of creating spaces and buildings to
provide a forum for common life. Furthermore, according to Van Ramondt, a
professor at the Bandung Institute of Technology (ITB), architecture is a space
where people live happily. Architecture in the above sense is only associated
with the creation of beautiful buildings and rooms and only as a place for
human life. Architecture is the art of designing buildings so that they have
aesthetic/beauty values. Beauty is values that are pleasing to the eye, mind and
ear.
While a computer program has an understanding based on Article 1 number 9 of Law Number 28 of 2014 concerning Copyright, namely:
“Article
1
9.Computer Program is a set of instructions that are expressed in the form of language, code, scheme, or in any form intended for computers to work to perform a certain function or to achieve a certain result.”
The
definition of Copyright itself is stated in Article 1 number 1 of Law Number 28
of 2014 concerning Copyright which states that:
“Article
1
1.Copyright is the exclusive right of the creator that arises automatically based on declarative principles after a work is realized in tangible form without reducing restrictions. in accordance with the provisions of the legislation.”
Copyright
is born and arises from the results of human thought in the fields of science,
art, and literature. Copyright arises automatically as soon as a work is born.
Copyright is a civil right attached to the creator. Copyright is a private
right. The justification is because a creation is born by the creator’s
creation. Creations that arise from the thought and creativity of the creator.
A copyright must be born from human creativity, not something that already
exists outside the activity or the result of human creativity. Copyright is an
exclusive right which consists of moral rights and economic rights. It is
called an exclusive right because the right is only reserved for the creator,
thus prohibiting/restricting other parties from using the right without the
author’s permission. Copyright holders who are not creators only have part of
the exclusive rights, namely in the form of economic rights. Moral rights are
distinguished from economic rights, economic rights contain economic value,
while moral rights have no economic value at all.
Moral
rights are rights attached to the creator. Moral rights cannot be removed even
after the copyright protection period has expired. Moral rights cannot be
transferred as long as the creator is still alive, but can be transferred by
will or other reasons in accordance with the provisions of the legislation
after the author dies. Moral rights also include neighboringrights.
Economic
rights are the rights for creators or copyright holders to get economic value
for their creations. Activities that economic rights holders can perform are:
publication of inventions; duplication of creation in all forms; translation of
inventions; adaptation; arrangement or transformation of the invention;
distribution of creations or copies thereof; invention show; announcement of
invention; creative communication; and rental of inventions.
These
rights not only provide personal benefits but also give hope to the growth of
the creative economy, the rapid development of the creative economy needs to be
fortified with legal protection considering that copyright is the most
important basis of the national creative economy.
Architectural works are
included as one of the protected works under Article 40 paragraph (1) of Law
Number 28 of 2014 concerning Copyright. The article reads:
“Article 40
(1)Protected works include works in the fields of science, art, and literature, consisting of:
a.books, pamphlets, presentations of published works, and all other written works;
b.lectures, lectures, speeches, and other similar creations;
c.teaching aids made for the benefit of education and science;
d.songs and/or music with or without subtitles;
e.drama, musical drama, dance, choreography, wayang, and mime;
f.works of art in all forms such as paintings, drawings, carvings, calligraphy, sculptures, sculptures, or collages;
g.applied art;
h.architectural works;
i.map;
j.batik art or other motif art;
k.photographic works;
l.Portrait;
m.cinematographic works;
n.translation, interpretation, adaptation, anthology, database, adaptation, arrangement, modification and other works resulting from the transformation;
o.translation, adaptation, arrangement, transformation, or modification of traditional cultural expressions;
p.compilation of Works or data, either in a format that can be read with a Computer Program or other media;
q.a compilation of traditional cultural expressions as long as the compilation is an original work;
r.video games; and
s.Computer program.”
In
addition to protected works, there are also works that are not protected by
copyright under Article 41 of Law Number 28 of 2014 concerning Copyright,
namely:
“Article 41
Works that are not
protected by copyright include:
a. works that have not
been realized in real form;
b. any ideas,
procedures, systems, methods, concepts, principles, findings or data even
though they have been expressed, stated, described, explained, or combined in a
Work; and
c. a tool, object, or
product that is created only to solve a technical problem or whose form is only
intended for functional needs.”
Classification of
protection against a copyright is divided into protection for 70 years, 50
years and 25 years depending on the creation. Protection for architectural works is
valid for the lifetime of the creator and continues for 70 years after the
author’s death, while protection for computer programs is valid for 50 (fifty)
years since the announcement was made, in accordance with the contents Article
58 paragraph (1) and 59 paragraph (1) of Law Number 28 of 2014 concerning
Copyright. The article reads:
“Article 58
(1)Copyright Protection of Works:
a.books, pamphlets, and all other written works;
b.lectures, lectures, speeches, and other similar creations;
c.teaching aids made for the benefit of education and science;
d.songs or music with or without subtitles;
e.drama, musical drama, dance, choreography, wayang, and mime;
f.works of art in all forms such as paintings, drawings, carvings, calligraphy, sculptures, sculptures, or collages;
g.architectural works;
h.map; and
i.a batik art work or other motif art,is valid for the life of the Creator and continues for 70 (seventy) years after the Creator’s death, commencing on January 1 of the following year.
“Article 59
(1)Copyright Protection of Works:
a.photographic works;
b.Portrait;
c.cinematographic works;
d.video games;
e.Computer program;
f.the appearance of the written work;
g.translation, interpretation, adaptation, anthology, database, adaptation, arrangement, modification and other works resulting from the transformation;
h.translation, adaptation, arrangement, transformation or modification of traditional cultural expressions;
i.compilation of Works or data, whether in a format that can be read by Computer Programs or other media; and
j.compilation of traditional cultural expressions as long as the compilation is an original work,
valid for 50 (fifty) years from the first
announcement.
In
the explanation of Article 40 letter h of Law Number 28 of 2014 concerning
Copyright, it is stated that what is meant by architectural works include,
among others, the physical form of the building, the layout of the building,
drawings of building designs, technical drawings of buildings, and building
models or mockups. From the explanation of the meaning of this architectural
work, it can be seen that an architectural work does not have to be in the form
of a real building, but it is sufficient that the design drawing alone can be
declared as an architectural work.
Based on the explanation
above, Architectural design drawings designed through computer programs can
also undergo changes that will not be considered as copyright infringement, if
the changes are made based on considerations of technical implementation, in
accordance with the provisions of Article 44 paragraph 1 and paragraph (3) of
Law Number 28 of 2014 concerning Copyright. The article reads as follows:
“Article 44
(1)The use, retrieval, reproduction, and/or modification of a Work and/or Related Rights product in whole or in part substantially is not considered a Copyright infringement if the source is mentioned or fully stated for the purposes of:
a.education, research, writing scientific papers, compiling reports, writing criticism or reviewing a problem without prejudice to the reasonable interests of the Author or Copyright Holder;
b.security and administration of government, legislature and judiciary;
c.lectures for educational and scientific purposes only; or
d.performances or performances that are free of charge provided that they do not harm the reasonable interests of the Author
(3)In the event that the Creation is in the form of an architectural work, the alteration as referred to in paragraph (1) shall not be considered as a Copyright infringement if it is carried out based on considerations of technical implementation.”
Furthermore,
who is entitled to the copyright of an architectural work designed on a
computer program can be known based on an agreement made by the parties. In
making architectural work in a computer program, of course, before using the
computer program, the creator of the work must agree to the terms and
conditions of use of the computer program. If the terms and conditions of use
regulate the copyright of a work to be produced, and the user of the computer
program agrees to the terms and conditions of use, then the copyright of the
work to be produced follows the copyright ownership agreement contained in the
terms and conditions. terms that have been previously agreed upon by the user
of the computer program.
The possibility of copyright infringement on architectural works
is quite high. Copyright infringement on architectural works can be in the form
of imitation or replication in full and intact an architectural copyrighted
work without the permission of the relevant creator, it can also be in the form
of imitating, adding, changing, several forms of architectural copyrighted
works without the permission of the creator so as to produce new architectural
works. Copyright infringement of imitation related to this architectural work
is in the form of similarities to almost the same between one architectural
work and another. Copyright is a cultural and paradigm problem in the
traditional view which until now has not completely disappeared, that the
community assumes a creation as a common property and even though individual
rights to a work get recognition, the form that is highlighted is more in the
moral perspective of Copyright than its economic value. If the architectural
work of an architect is replicated or imitated without permission, he will
experience losses from an economic and moral point of view. The creator gets
economic benefits from his own creation and related products because of the
Economic Rights.
Article
9 paragraph (3) of Law Number 28 of 2014 concerning Copyright in it regulates
the protection given to creators for their works where it is stated:
“Article
9
(3)
Any person without the permission of the Author or Copyright Holder is
prohibited from Reproduction and/or Commercial Use of Works.”
Then
Article 9 paragraph (1) of Law Number 28 of 2014 concerning Copyright regulates
the economic rights of creators and copyright holders as follows:
“Article 9
(1)The Creator or Copyright Holder as referred to in Article 8 has economic rights to:
a.publication of Works;
b.Reproduction of Works in all its forms;
c.translation of Works;
d.adapting, arranging, or transforming the Works;
e.Distribution of Works or copies thereof;
f.performances of Creation;
g.Announcement of Works;
h.Creative Communications;
i.rental of Works.
This
supports the creator so that if there is a case of imitation of architectural
copyrighted works, it is already a Copyright violation. With the existence of
economic rights, prohibiting other people from using a copyrighted work with
the aim of commercializing it without the permission of the creator. The
purpose of using the work for commercial purposes is as regulated in Article 1
number 24 of Law Number 28 of 2014 concerning Copyright, namely the use of
related works and/or products with the aim of obtaining economic benefits from
various sources or paid.
Law
Number 28 of 2014 concerning Copyright has not regulated in detail the main
points of architectural works that can be protected as a condition of
assessment to determine that an architectural work can be said to be an
original work or a work of imitation from other works. In terms of moral rights
as well as economic rights, the act of replicating architectural works without
obtaining permission from the creator or copyright holder to commercialize them
is a violation.
Article
99 paragraph (1) of Law Number 28 of 2014 concerning Copyright stipulates that
a civil lawsuit can be filed by the creator or copyright holder of
architectural works who suffer losses due to infringement of their works. The
article reads as follows:
“Article 99
(1)Authors, Copyright Holders, or Related Rights owners have the right to file a claim for compensation to the Commercial Court for infringement of Copyright or Related Rights products.”
Not
only civil lawsuits that can be filed by creators or holders, criminal charges
can also be filed against perpetrators of copyright infringement of
architectural works without the permission of the creator whose new works of imitation
are commercialized. Article 113 paragraph (3) of Law Number 28 of 2014
concerning Copyright regulates the criminal provisions which read:
“Article
113
(3)violates the economic rights of the Creator in the form of publishing the work, all forms of duplicating the work, distributing the work or copies thereof, and/or publishing the work. for commercial use shall be punished with imprisonment for a maximum of 4 (four) years and/or a fine of a maximum of Rp. 1,000,000,000.00 (one billion rupiah).”
Since
the enactment of the latest Copyright Law, namely Law no. 28 of 2014 concerning
Copyright states that Copyright infringement is a complaint offense, as stated
in Article 120 of the Copyright Law, a criminal act as referred to in this law
is a complaint offense. It can be concluded that there must be someone who
reports first with a request to make a claim against a certain person or party
so that a criminal act can be prosecuted.
It is hoped that in the
future the occurrence of a copyright infringement can be prevented by the
existence of regulations and large criminal sanctions, especially in the field
of architectural works which have the possibility of a copyright infringement
in the future. It is highly recommended to creators and copyright holders that
their copyrighted work be registered, even though it does not require
registration because Copyright is automatic which appears when a work has been
created. If in the future there is a dispute over a copyrighted work, the
Copyright Registration Letter can be used as evidence in court. Therefore, it
is important to register architectural works as regulated in Article 21 of Law
Number 6 of 2017 concerning Architects which stipulates that architects have
the right to register intellectual property for their works.
